Acceptable Use Policy

Summary

FirstLight Fiber has formulated this Acceptable Use Policy (“AUP”) in order to encourage the responsible use of FirstLight’s networks, systems, services, web sites and products (“FirstLight Services”) by our customers (individually a “Customer” and collectively “Customers”) and other users of the FirstLight Services (a Customer or Customer and other such users are collectively, “Users”). This AUP outlines prohibitions that violate the AUP and provides consequences, which include suspension and termination of services provide by FirstLight, in the event of a violation. By using the FirstLight Services, Users consent to comply with and be bound by the terms of this AUP. FirstLight reserves the right to modify this AUP in its discretion at any time. Such modifications will be effective when posted. Any use of the FirstLight Services after such modification shall constitute acceptance of such modification.

General Prohibitions

The FirstLight Services, regardless of access method, must be used in a manner that is consistent with their intended purpose and may be used only for lawful purposes. Users shall not use the FirstLight Services:
Notwithstanding the specific examples, prohibited conduct includes transmitting, distributing, or storing data, content or other material, and any action or inaction that may facilitate a violation of this AUP.

Prohibitions – Specific Examples

Inappropriate Content

Users shall not use the FirstLight Services to access, transmit, distribute or store material that is inappropriate, obscene (including but not limited to child pornography), defamatory, libelous, threatening, abusive, hateful, or excessively violent.

Intellectual Property Infringements

Material or content accessible through the FirstLight Services may be subject to protection under laws pertaining to privacy, publicity, or intellectual property rights. Users shall not use the FirstLight Services in any manner that would infringe, dilute, misappropriate, or otherwise violate such rights. User’s use of a domain name in connection with any of the FirstLight Services must not violate the rights of any third party.

Harmful Content

Users shall not use the FirstLight Services to transmit, distribute or store material that may be harmful to or interfere with the FirstLight Services or any third party’s networks, systems, services, or websites. Prohibited harmful content includes, but is not limited to, viruses, worms, or Trojan horses.

Fraudulent or Misleading Content

Users shall not use the FirstLight Services to transmit or distribute material containing fraudulent offers for goods or services, or advertising or promotional materials that contain false, deceptive, or misleading statements. Users are prohibited from submitting false or inaccurate data on any order form, contract or online application, including fraudulent use of credit cards.

Email Abuses and Unsolicited Messages

Users shall not use the FirstLight Services to transmit unsolicited e-mail messages, including bulk email (“spam”). Further, Users are prohibited from using another provider to send spam promoting a site hosted on FirstLight Services. Additional prohibitions include:

Internet Forums and Related Application Rules

Users may have access to forums, bulletin boards, user groups, or other services with their own rules or agreements. Violating such rules or agreements is prohibited.

Security and Disruption Activities

Users shall not use the FirstLight Services to conduct harmful activities, including flooding, denial of service attacks, phishing, or related activities. Attempting to violate the security of the FirstLight Services or third-party networks is prohibited. Activities such as scanning, probing, or information gathering are also prohibited. FirstLight may investigate and cooperate with law enforcement in such cases.

Content

FirstLight takes no responsibility for content created or accessed through its services. While not obligated to monitor, FirstLight reserves the right to block, suspend, or terminate access to content that violates this AUP, and to cooperate with legal authorities in investigations.

Consequences of Violations – Enforcement

If a User breaches this AUP, FirstLight may suspend or terminate service with or without notice. Enforcement is solely at FirstLight’s discretion. FirstLight may notify a Customer to cure the violation but has no obligation to do so. Suspension or termination may occur if, in FirstLight’s discretion, the violation:
FirstLight may take further action to prevent repeat violations and shall not be liable for damages resulting from enforcement of this AUP.
